Unlawful Encampment Injunction

On Friday 12 January 2018, the High Court granted a final Injunction order for a period of 3 years until 12 January 2021 preventing anyone (Persons Unknown) from:

  • Setting-up an encampment on any Land identified on the map (see below) on sites numbered 1 to 129 without written permission from the Local Planning Authority, or, planning permission granted by a planning inspector;
  • Entering and/or occupying any part of the Land identified on Map 1 at sites numbered 1 to 129 for residential purposes (temporary or otherwise) including caravans, mobile homes, vehicles, and residential paraphernalia;
  • Bringing on to the Land identified on Map 1 at sites numbered 1 to 129 or stationing on the Land any caravans/mobile homes other than if driving through the Borough of Waltham Forest or in compliance with the Parking Orders regulating the use of car parks or with express permission from the owners of the Land;
  • From bringing on to the Land identified on Map 1 at sites numbered 1 to 129 any vehicle whether for the purposes of disposal of waste and materials or otherwise, other than when driving through the Borough of Waltham Forest or in compliance with the Parking Orders regulating the use of car parks or with express permission from the owners of the Land.
  • The Land in this Order means all the land within the Borough of Waltham Forest as marked on Map 1 numbered 1 to 129 and listed on the Schedule.

The injunction order contains a penal notice which means anyone breaching it will be in contempt of court. If they do not move or move onto any other open space within the borough controlled by the council, they will be in contempt of court and may be arrested.

The injunction order is being posted up at all entrances to Waltham Forest’s parks and open spaces in compliance with the order.

On 23 February 2018 the High Court granted a final Injunction order (2MB, PDF) for a period of 3 years until 12 January 2021.
