Who we are and what we do

The Premises Licensing service undertakes administrative and enforcement actions in relation to a range of licensing functions.

Information we hold about you

To carry out activities and obligations we may process personal information in relation to:

  • Personal contact details, such as names (including previous names), title, addresses, telephone numbers and personal email addresses.
  • Personal demographics including date of birth, gender.
  • Other contact details, such as names, addresses, telephone numbers and personal email addresses.
  • Other information such as national insurance number, nationality, evidence of entitlement to work in the UK, payment information.

Criminal Offence Data:

We may process data relating to any criminal offences (including alleged offences), criminal proceedings / investigations, outcomes and sentences relating to you.

Why we need your information and how we use it?

Premises Licensing uses various kinds of information including personal data and occasionally special categories data (previously called sensitive personal data). The main purposes for which we may process your personal information are:

  • The processing of licensing applications (including inspections / advisory visits)
  • The processing of payments in relation to licensing functions
  • To investigate relevant complaints or enquiries
  • To carry out pro-active enforcement activities to ensure compliance
  • To allow us to communicate and provide relevant information in relation to licensing changes
  • To keep a public register in relation to the authorisations which we have issued.
  • For the prevention and/or detection of fraud and/or crime
  • To fulfil a legal obligation

The Lawful basis for the processing

Under the GDPR, the lawful bases we rely on for processing this information is outlined in article 6(1) (e) - Public Task. The processing is necessary for the data controller to perform a task in the public interest or for official functions and the task or function has a clear basis in law. 

We have a statutory obligation to provide these services in accordance with the following legislation:

  • Licensing Act 2003
  • Gambling Act 2005
  • London Local Authorities Act 1991
  • Explosives Act 2014
  • Scrap Metal Dealers Act 2013
  • Hypnotism Act 1952
  • The Local Government (Miscellaneous Provisions) Act 1982
  • Policing and Crime Act 2009
  • Immigration Act 2016

In carrying out our duties we may share your information with:

  • Applicants
  • The Police
  • Responsible Authorities (as defined by the Licensing Act 2003 and the Gambling Act 2005)
  • Internal Council Departments
  • Licensing Sub-Committee
  • Other Local Authorities
  • Home Office
  • HM Revenue and Customs
  • Other organisations, where the disclosure is necessary for the purposes of the prevention and/or detection of crime

Information obtained from another source

We also collect or receive information from external parties such as:

  • Members of the Public
  • Internal Council Departments
  • The Police
  • Other Local Authorities
  • Home Office
  • Responsible Authorities (as defined by the Licensing Act 2003 and the Gambling Act 2005)

  • Disclosure and Barring Service (DBS)

How long we will keep your information

All personal information will be held securely and will only be retained electronically for as long as is necessary for the purpose for which it was provided.
